Intellectual Property (IP) Rights
Magic Trader® a/k/a Multidimensional Risk Analysis Systems, Magic Trader University®, Magic Trader Consulting ®, Scalp-Swing® contents/Definitions, symbology/methods and Magic Trader® related Patents are the intellectual property of the Inventors and/or their successors/assigns. Charts created using Metastock are the basis used to create Magic Trader® technology (MULTIDIMENSIONAL RISK ANALYSIS SYSTEMS). The principal of SAVE DOLLAR ENTERPRISES, INC. has intellectual property and other rights related to the Magic Trader® Trademarks, Service Marks, Copy righted materials, MULTIDIMENSIONAL RISK ANALYSIS SYSTEMS products & trainings (patents granted & pending).
Any unauthorized use (including, but not limited to: copying of ideas in part or full; using our Trade Marks, Service Marks, Patent specifications, replicating any part of Magic Trader® Products, Magic Trader® (MULTIDIMENSIONAL RISK ANALYSIS SYSTEMS) training material, Magic Trader Consulting ®, Magic Trader University® related material, Scalp-Swing® related material; Magic Trader® Patent related specifications, managing others' money using Magic Trader® (MULTIDIMENSIONAL RISK ANALYSIS SYSTEMS); creating a signal service using Magic Trader® in any manner; recording; creating Magic Trader® educational classes, user groups, social media accounts/pages, broadcasts, chat rooms, etc.; recording & distribution of Magic Trader® (MULTIDIMENSIONAL RISK ANALYSIS SYSTEMS) charts; any commercial application, whether for profit or not) will violate the intellectual property and other rights of the inventor, of SAVE DOLLAR ENTERPRISES INC, its principals, its successors, assigns, appointed heirs, entities, and/or trusts and other parties.
The Site and the content contained herein, as well as all copyrights, including without limitation, the text, documents, articles, products, software, graphics, photos, sounds, videos, interactive features, services, links, User Submissions (as defined below), third-party apps, and any other content on the Site (“Content”) and the trademarks, service marks and logos contained therein are the property of Save Dollar Enterprises, Inc. and its third-party licensors or providers. You may access and use the Content, and download and/or print out copies of any content from the Site, solely for your personal, non-commercial use. If you download or print a copy of the Content for personal use, you must retain all copyright and other proprietary notices contained therein. You acknowledge that you do not acquire any ownership rights by using the Site. Save Dollar Enterprises, Inc. reserves all rights not expressly granted in and to the Site.
You may not use, copy, display, sell, license, de-compile, republish, upload, post, transmit, distribute, create derivative works or otherwise exploit Content from the Site to online bulletin boards, message boards, newsgroups, chat rooms, or in other any manner, without our prior written permission. Modification of the Content or use of the Content for any purpose other than your own personal, noncommercial use is a violation of our copyright and other proprietary rights, and can subject you to legal liability.
In addition, in connection with your use of the Site and its services, you agree not to:
- Restrict or inhibit any other visitor from using the Site, including, without limitation, by means of “hacking” or defacing any portion of the Site;
- Use the Site for any unlawful purpose;
- Express or imply that any statements you make are endorsed by us, without our prior written consent;
- Modify, adapt, sublicense, translate, sell, reverse engineer, decompile or disassemble any portion of the Site;
- Disable, damage or alter the functioning or appearance of the Site, including the presentation of advertising;
- “Frame” or “mirror” any part of the Site without our prior written authorization;
- Use any robot, spider, site search/retrieval application, or other manual or automatic device or process to download, retrieve, index, “data mine,” “scrape,” “harvest” or in any way reproduce or circumvent the navigational structure or presentation of the Site or its contents;
- Harvest or collect information about visitors to the Site without their express consent;
- Send unsolicited or unauthorized advertisements, spam, chain letters, etc. to other users of the Site; or
- Transmit any Content which contains software viruses, or other harmful computer code, files or programs.
Any posts/publication/Webinar Training/seminar/text messages material, either in portion or in full, must not be copied, replicated, email blasted, social media blast, signal service, reproduced, teach others, circulated, distributed or commercialized for any purposes without written permission of the inventor and/or author. The violator will be responsible for all legal fees, monetary damages and other penalties under U.S. and international laws. You hereby agree to pay for all legal fees for violation of Intellectual and copyrights. Magic Trader® (MULTIDIMENSIONAL RISK ANALYSIS SYSTEMS) Products are only licensed for use on securities trading and for Personal use only.
Application of Magic Trader® (MULTIDIMENSIONAL RISK ANALYSIS SYSTEMS) Products or Magic Trader® (MULTIDIMENSIONAL RISK ANALYSIS SYSTEMS) services other than Stocks, Commodities, Bonds, Mutual Funds, ETFs, Notes, Foreign currencies, Derivatives, Futures, Options, Crypto Currency, REITS, and/or securities, without permission will be a Violation of our Intellectual property rights. Ask Save Dollar Enterprises, Inc. for more details. Licenses leased to named individuals as defined within Innovative Market Analysis, LLC d/b/a Metastock’s records must solely be utilized by the named individual only. Please refer to the Licensing Agreement signed for further details. Innovative Market Analysis, LLC d/b/a Metastock possesses the exclusive right to market all versions of Magic Trader®.
Permitted User/Subscriber hereby agrees to refrain from filing Trademarks, Servicemarks and/or Patents related in any way, shape, form, idea, content, or concept to Magic Trader® a/k/a Multidimensional Risk Analysis Systems and any and all related topics to Magic Trader® a/k/a Multidimensional Risk Analysis Systems, including but not limited to: Magic Trader Consulting®, Magic Trader®, Magic Trader University®, Scalp Swing®, Magic Zone Level℠, Magic Zone Lines℠, Magic Lines℠, Magic Trader® Preceptors℠, Magic Yellow Bar℠ and/or any future filings as it relates to Magic Trader® (all versions of Magic Trader®) and/or any and all of its topics.
Permitted User/Subscriber agrees to assign to Save Dollar Enterprises, Inc., also referred to as the “SDEI” or its designee, all right, title, and interest in and to any and all inventions, original works of authorship, developments, concepts, improvements, designs, drawings, discoveries, algorithms, formulas, computer code, ideas, trademarks, or trade secrets, whether or not patentable or registrable under patent, copyright or similar laws, related to the SDEI’s business, which the Permitted User/Subscriber may solely or jointly conceive or develop or reduce to practice, or cause to be conceived or developed or reduced to practice, with the use of SDEI’s equipment, supplies, technology, facilities, assets, or SDEI’s Confidential Information, or which may arise out of any research or other activity conducted under the direction of the SDEI (collectively referred to as “Intellectual Property”). The Permitted User/Subscriber understands and agrees that (i) all original works for authorship which are made by the Permitted User/Subscriber (solely or jointly with others) within the scope of the SDEI’s business which are protectable by copyright, patent, intellectual property or trade secret laws, rules or regulations; or (ii) the decision whether or not to commercialize or market any Intellectual Property is within the SDEI’s sole discretion and for the SDEI’s sole benefit and that no royalty or other consideration will be due to the Permitted User/Subscriber as a result of the SDEI’s efforts to commercialize or market any such Intellectual Property.
Permitted User/Subscriber shall not privately/or publicly share Magic Trader® notes, charts, screen shots, recordings or other confidential information or intellectual properties of SDEI with anyone without explicit written permission from SDEI management. Permitted User/Subscribers are hereby prohibited to transmit, replicate, and/or disseminate FOSetup.exe files in any way, shape, or form and are prohibited from modifying indictors and integrating the indicators with other items (including but not limited to third-party indicators and applications).
Permitted User/Subscriber agrees that s/he/they shall not disclose any information regarding actual and/or claimed trading performance and agree to hold harmless and indemnify SDEI and Metastock from any liabilities and/or damages.
Permitted User/Subscriber must not have any financial licenses with any governmental authority, including but not limited to SEC, FINRA, CFTC, NFA, etc. The Magic Trader®️ license and software provided by MetaStock and SDEI is for end-users that are non-professional [non-financial] end-users regardless of the country they reside in and/or are using the Magic Trader®️ software from. Any Users/Subscribers who are a licensed financial professional are prohibited from using Magic Trader®️ and are prohibited from using family members and/or other friends and relatives (who are non-professional, non-financial users) names to subscribe to Magic Trader®️ and/or any of its related products/services. Such unauthorized users/subscribers will be held responsible for any and all legal fees. SDEI/Metastock reserves the right to refuse issuing a month to month lease for Magic Trader®️ and/or subscription to any Magic Trader®️ Consulting products, if any family or relatives' names are used to subscribe to Magic Trader®️ and/or any Consulting Service products in order to gain access through those sources. Failure to disclose if you and/or a relative/family member are a licensed financial professional is a violation of the terms and conditions of this licensing agreement. SDEI reserves the right to terminate the agreement at any date due to violation of this agreement. Refund may be given on a pro-rated basis for the month-to-month lease depending on a case to case basis. The Magic Trader®️ license for professionals is handled differently and on a case to case basis which comes at a higher cost and approvals are required.
